Candidate Privacy Statement

As part of our recruitment process, TIBCO collects and processes personal data relating to job applicants. We are committed to being transparent about how we collect and use that data and to meeting our data protection obligations. You are under no statutory or contractual obligation to provide data to TIBCO during the recruitment process. However, if you do not provide the information, we may not be able to process your application properly or at all.

The Kind of Information We Hold About You

We will collect, store, and use the following categories of personal information about you:

  • The information you have provided to us in your CV and covering letter.
  • The information you have provided on our online application tracking system (Hirebridge), including your name, address, telephone numbers, personal email address, employment history and qualifications and your right to work in the country to which you have applied.
  • Any information you provide to us during an interview.
  • Information received as part of the Criteria Cognitive Aptitude and personality testing process (“CCAT”)

We may also collect, store and use the following "special categories" of more sensitive personal information:

  • Information about your health, including any medical condition

How is Your Personal Information Collected?

We collect personal information about candidates from the following sources:

  • You, the candidate.
  • Any recruitment agency, from which we collect data via the Hirebridge system including your name, address, telephone numbers, personal email address, employment history and qualifications and your right to work in the country to which you have applied.
  • Hireright background check provider, from which we collect the following categories of data only at the point which (subject to the results of the background checks) we wish to make you an offer of employment and you have indicated that you would accept that offer
    • proof of your legal right to work in the country you have applied to;
    • proof of your name and current address and your social security number;
    • an employment reference from an employer with whom you have been continuously employed in the three month period prior to the date of commencement of employment or an academic reference if you have been in full time education within the 3 months prior to employment start date with TIBCO;
    • if required for the role you are applying for, information about your credit history.

How We Will Use Information about You

TIBCO has a legitimate interest in processing personal data during the recruitment process and for keeping records of the process. Processing data from job applicants allows us to manage the recruitment process, assess and confirm your suitability for employment and decide to whom to offer a job. We may also need to process data from job applicants to respond to and defend against legal claims and to comply with

How We Use Particularly Sensitive Personal Information

We will use information about your disability status to consider whether we need to provide appropriate adjustments during the recruitment process. For example, we will consider whether adjustments need to be made during CCAT assessment process or for interview arrangements.

Information about Criminal Convictions

We do not envisage that we will process information about criminal convictions during the application process, with the exception of a very limited set of roles. If you are successful in your application for work with TIBCO, we may in the future collect such information from you in very limited circumstances. If this applies to you now or in the future, we would provide you with more information about the policies and safeguards we have in place to ensure appropriate processing of criminal record information.

Automated Decision-making

You will not be subject to decisions that will have a significant impact on you based solely on automated decision-making.

Data Sharing

Why might you share my personal information with third parties?

We will only share your personal information with third parties for the purposes of processing your application and (where you are successful in your application) for the purposes of our on-boarding processes.

Which third-party service providers process my personal information?

We may share your personal information with service providers (including contractors and designated agents) and other entities within our group. The following activities are currently carried out by third-party service providers: applicantion tracking services, background checking, CCAT testing; payroll, pension administration, benefits provision and administration and IT services.

When might you share my personal information with other entities in the group?

We will share your personal information with other entities in our group as part of our regular reporting activities on company performance, for system maintenance support and to facilitate the administration of your application and (where applicable) the subsequent onboarding process.

How secure is my information with third-party service providers and other entities in our group?

All our third-party service providers and other entities in the group are contractually required to take appropriate security measures to protect your personal information in line with our policies. We do not allow our third-party service providers to use your personal data for their own purposes. We only permit them to process your personal data for specified purposes and in accordance with our instructions.

We also disclose your personal information to “Vista” (as Vista Consulting Group and Vista Equity Partners, together with their affiliates, and as sponsor of TIBCO), for administration, research, database development and business operation purposes, in line with the terms of this Privacy Policy. Vista processes your personal information on the basis of its legitimate interests in overseeing the recruitment process and, if applicable, your employment relationship with TIBCO. If you have consented to us doing so, we also share your personal information with other Vista portfolio companies for the purpose of being considered for other job opportunities in the pooling system, both inside and outside the EEA. Where this requires us to transfer your personal information outside of the EEA, please see below.

Transferring information outside the EU

If you are an EU resident, we may transfer the personal information we collect about you to other countries. To ensure that your personal information does receive an adequate level of protection we have put in place appropriate measures to ensure that your personal information is treated by those third parties in a way that is consistent with and which respects the EU and local laws on data protection which include binding legal agreements entered into between entities within the TIBCO group

Who has access to data?

Your information may be shared internally for the purposes of the recruitment exercise. This includes members of the HR and recruitment team, interviewers involved in the recruitment process, managers in the business area with a vacancy and IT staff if access to the data is necessary for the performance of their roles. We will not share your data with third parties, unless your application for employment is successful and we make you an offer of employment. We will then share your data with former employers to obtain references for you, employment background check providers to obtain necessary background checks.

How do we protect your personal data?

We take the security of your data seriously. We have internal policies and controls in place to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our employees in the proper performance of their duties.

Data Retention

How long will you use my information for?

We will retain your personal information for a period of 12 months after we have communicated to you our decision about whether to appoint you to the role you have applied for. We retain your personal information for that period in order to perform our contractual relationships with recruitment agencies (where applicable), so that we can show, in the event of a legal claim, that we have not discriminated against candidates on prohibited grounds and that we have conducted the recruitment exercise in a fair and transparent way. We may also be approached by social security organisations for information they may require in order to assess your entitlement to statutory benefits relating to a period of unemployment or low income. After this period, we will securely destroy your personal information in accordance with our data management policy.

If your application for employment is successful, personal data gathered during the recruitment process will be transferred to your Human Resources file (electronic and paper based) and retained during your employment.

If your application is unsuccessful, TIBCO may keep your personal data on file in case there are future employment opportunities for which you may be suited, if you have consented to our doing so.

Rights of Access, Correction, Erasure, and Restriction

Your rights in connection with personal information

If you want to review, verify, correct or request erasure of your personal information, object to the processing of your personal data, or request that we transfer a copy of your personal information to another party, please contact Human Resources.
